Married in NZ, He there, I’m in Australia, apart 3yrs, married 23 months, can he refuse divorce? also…?

Also should i divorce in Australia or NZ? If he opposes divorce, do i have to face him in court? Is there anyway of my address/details not be on the papers served to him? The marriage was violent, the seperation was not amicable and he doesn’t know where I am as I had to flee NZ to get away from him. I’m sorry for all the questions! Any advice is appreciated!

I’m from Australia too, not sure about NZ law but in Australia you can’t refuse a divorce, you can try but the court will just issue one. If you finances are low contact nearest legal aid office and fill out an application but tell them your applying for funding to choose a private solicitor, that way you don’t get stuck with the dodgy ones they appoint,(its exactly the same they just pay for a private solicitor you choose).. Then get legal representation to put through the divorce application. Tell them you don’t wish to see him and the reasons and they will help you work around it. Good luck.

ADD i also don’t advise going back to NZ to do it, the further you are from him the better. If there is a history of violence there should be a legal loop hole that will let you withhold your personal details. Good luck
