Getting divorced and I believe Wife pulled money out of 401K?
I am in the middle of getting papers I need together to combat a wife who is very evil. In short she has placed a No Contact Order on me and has had it since late Feb. Her Lawyer is a prick in every aspect. Anyway I still ge some of her mail here once in awhile and happen to open a booklet from her 401k investment company (TDS Systems) Not much in the thing except for the for a request for hardship instructions and the actual forms to fill out. I guess at this point I dont know if she with-drew her retirement funds hiding them or if this was just a generic mailing. I get the idea from reading it that it it was a requested form.
Do not sit back and let this happen, man. That is illegal what she is doing, because you are marred.
On the form ? There is a place for your signature. That can’t be forged.
The reason ? Legally, the husband has to be notified.
So, if she does take the money out without your permission (forging your signature) you can sue her.
